Even though the government advocates for testing in such cases, healthcare providers' privacy should be very high and confidential. The Supreme Court in the U.S has held that, whether the intent is to alert the police to possible crimes, medical employees cannot screen pregnant patients in prescription substances without their written consent or a proper warrant. The Court's ruling by 6 to 3 was taken by women convicted in a ten-year-old case against Charleston, Southern Carolina, under a co-operative scheme involving a public hospital and the police force after a positive urine examination for cocaine (Arnold 2021).
