Facts The case at the Supreme Court was a consolidation of two different cases which to some extent, had similar facts. In the consolidate case, the first defendant had been convicted by jury in San Diego. He was convicted for the assault crime of drive by shooting. His appeal was based in the fact that police had illegally obtained his phone where they were able to get the evidence that incriminated him to the crime(Clancy, 2015). The second defendant was one who had also been convicted for dealing in drugs and weapons. His case too was a whereby the police in doing their normal duties had stopped him and did a search where they obtained the evidence. He was prosecuted and convicted.
