Consider the following statement: In the application of the common law of negligence, there is a four part test which must be met under the standard set in Palsgraff. That standard was used to LIMIT corporate liability. What happens if manufacturers are held accountable for all injuries caused by the products they manufacture? Does your opinion change if the injuries occur to a child? What about when the product is being used for a purpose for which it was not intended, as when an oven is being used to heat a home during a power outage and a fire ensues? What are the social consequences of legislative limits to tort liability for manufacturing? Does a state which has a $$ limit on tort damages become more attractive to business thinking about relocating?

Law of NegligenceNegligence is a situation whereby one fails to exercise the expected ethical or any other practices (Shearman, Redfield & Zipp, 1964). Negligence law states that the harm is likely to occur due to the failure to do the expected. The injury that arises is associated with carelessness. Any damages that occur due to negligence are not sueable since this is a personal mistake rather than the mistake of the producer. In the case where a specific manufacturer comes up with a product, there is always a manual that directs the use of the product. In this case, therefore, the people using the products should be cautious to carefully read through the manuals to ensure that the product causes no harm.
